Dear Madam I need urgent help.
To whom it may concern,(Gujarat State Police Complaints Authority(GSPCA,Your Complaint No is ANDR-2 and 3

i am writing this email on behalf of my dad (Jyoti) so please correspond to both myself and him copied into this email.

I would like to bring your attention a experience I had while I was on a trip to India recently, that I think is unfair treatment and want to raise this further, my name is Jyotikumar Chunibhai Patel I hold a British passport and before I left London I applied for a liquor permit holder, which I received.

REF: E COURT INDIA CASE NO-84/17, GUJRAT, ANAND- JITODIA

I flew to india on the 22nd December 2016 I went with my brother in law for a holiday. I returned to London on the 24th January 2017.

On the 17th January I had a invite to go to my friends daughter’s wedding reception, while getting ready myself and my Brother in Law Dhimant patel had a few beers at our house in motikaka Park, Anand, and Gujarat at around 12:00pm. The party was, located in Suraya Farm Bakrol at 8:30pm. We went to the party by taxi.

After the taxi dropped us off at the location we sat down in the venue to listen to the music and celebrate the weddings for my friend’s daughter. We were at the venue for approximately 2 hours. we then decided to go home so waited for our taxi outside on the road, which we could not locate.

We decided to ask some people from the venue if they were going through Vidyahyanagar Road, Anand when we managed to get a lift from one of the local men. We started walking towards his car when an officer who was not wearing uniform came to the car and searched and found whisky. When the owner of the car saw the officer with no uniform he ran away. My first question is shouldn’t this officer at least tell us who he is? And show us some ID? This was not our vehicle but to be treated this way was unfair to us and the driver of the car.

Me and my brother in law were left standing by the vehicle after the driver had run away, I would like to state we had no idea what was in his car or had nothing to do with the contents of the car. We informed the officer that this car does not belong to us and that we are British citizens and we were at the party as guests. He then started shouting at us why have you got this whiskey bottle in the car, where did you get it from, we explained again we were getting a lift and going home. He then chose to ignore us and started to become angry and said “ I will give you better then a FIR you bloody foreigner, I will make sure you are locked up for a long time”. I was shocked at the way he spoke to me, I want to make you aware that I would like this police officer to be punished for the way he handled this case.

The police officer who filled a report against us had made false allegations, i am sure you will be able to obtain a copy as I got a English translated version. The officer made allegations that we were all drunk and could not walk straight. However we had not consumed alcohol in the last 8 hours where we drank 2 bottles of beers at our own home before we came to the party. Also you will notice in the report that for every person mentioned in the statement had the same allegation I have no idea how a police officer can make false statements especially the ones that are the same, we did not have blood shot eyes or could not walk, they did not give us the chance to even proof that we were not druk. The officer also made threats against us.

They then took me and my brother in law and 6 others to Vidhynaghar police station jail and took our personal possessions which included our mobile phone as we had asked to make a call to our family’s in London as they will get worried we are not able to communicate to them, they shouted no and took it off us. This added to the stress we were put through as we later learned that our families were really worried about us and were trying to get hold of us. When we got to the police station the policemen abused us by kicking and hitting us as they dragged us to a police cell while doing this they shouted and swore at us. The police cell was very small with urine all over the floor and tobacco, which has already been, chewed and spat out on the floor and walls. It was unhygienic and dirty which meant that we had to stand in the small cell all night. As we couldn’t lay on the floor and nothing was given to us to product us from the filth. While in custody I was ill from food poisoning the food conditions in that jail are disgusting I wouldn’t even wish my worst enemy to eat that food, it caused me to have diarrhoea which didn’t help as we were in a crowded cell . As well as this I am a 60 year old man who has a medical heart condition and I am also diabetic who also suffers from high blood pressure. I had told the officer this information as well as the fact that I needed my medication. I take around 10 tables 2 times a day without this medication I get sever pains and the level of stress that I was under did not help, they ignored me and refused to allow me to call someone to give me my medication.

They then dragged us out the cell and pushed us through the corridors where they forced us to go to the hospital to get a blood test. If they had explained to us what they were doing and where to go we would walk there was no need to push and treat us in this way. We were not treated like humans more like animals and I am disgusted by the treatment that we received by brother in law saw I was stressed due to no medication and the treatment he was very angry and kept asking them to let me have my medication and to call home which they refused.

Next morning the police officer forced all 8 of us to take pictures with the local papparazi who were waiting outside. In my eyes this is the policeman trying to make himself look good as they ‘caught people drinking’ we are not animals to be paraded about and this is not something that we agreed to but in turn if we refused we were met with them raising their hands and shouting at us. This is another serious issue I wanted to be addressed. My family found out about us being in jail due to these tabloids and were really upset they could not find out more. I would like this to be raised as a serious issue. In the afternoon they took us to the court and the court had rejected our case with no given reason and no evidence, I would like to know the reason for this. After we returned to our cell where the officers had repeatedly pushed us, and verbally abused us.

That same day we went to court again in the afternoon and our case was refused for the second time. Again no reason and no evidence, it seems that the police and courts in India are not organised and cannot proof anything, the next day on the 19th we went to court and the judge and decided to send us to the central jail in Anand Gujarat. At this point we had been jailed for 2 nights in bad conditions and with bad treatment. There was no proof no evidence we had supplied our liquor permits for the drink we had drank at home and also they had did their checks for the cars which did not belong to us. There was no reason to keep us in jail for this long. There was a murderer in there that got released after one night.

On the 21st January the case was taken to the middle court however we were not present at this time. We were then granted bail, but still not given our mobile phones, we had all the paperwork for our phones at home in London. During my time in the jail in the last few days I had suffered from sharp chest pains and anxiety due to the stress that this case and the poor living conditions has caused me. This is the worst treatment I have received in my 60 years my brother in law is also really upset by the way things happened and the treatment.

I repeatedly told officers that I was not feeling well and my chest pains were worsening however they laughed and ignored me. Now if I had suffered an attack while in jail I’m sure the policemen would have left me to die, as they have no emotional attachments I am really unhappy with the treatment and the pain it has caused me as well as my family who have all been worried about me.

I would like to put in a complaint for the way I was treated and how the whole case was auctioned. Ive never been treated like this and was so relieved to be back home.

if you would like further information please let me know as i have supporting documents that i can send.

i would like this email to be received as a complaint. i would also like to make you aware that this has been raised to the local MP here in London and the Minister for Asisa and the Pacific whom has given me the details for yourself to lodge a formal complaint.

    yours sincerely.

    Jaina and Jyoti Patel.
