Ltd. shown his greatness, courage and openly inform facts in his re port dated 3-9-1999 after 13 years to Hon'ble Court that the official liquidator may be permitted to take possession of the same in modification of the order 3rd Sept. 1986 passed by Hon'ble Court in Company application No. 179 of 1986 ..WHY SUCH DELAY AND INJUSTICE TO EXAMINE TO FACTS OF ALL ORDER PASSED IN THIS CASE???? OLD COMPANY REGISTOR THEY MISSPLACE HIGH COURT MUMBAI THIS CASE FILE.WHICH SPEAK THEM SELVES FOR MY JUSTICE???????

Hon'ble Court that the official liquidator may be permitted to take possession of the same in modification of the order 3rd Sept. 1986 passed by Hon'ble Court in Company application No. 179 of 1986 ..WHY SUCH DELAY AND INJUSTICE TO EXAMINE TO FACTS OF ALL ORDER PASSED IN THIS CASE???? ASK YOR CONSCIOUS WHO WAS TO BLAME FOR MY AND 800 WORKERS JUSTICE???

Mr. Ujjwal Roy Official Liquidator and Liquidator of M/s. Choonilal Manilal Pvt. Ltd. shown his greatness, courage and openly inform facts in his report dated 3-9-1999 after 13 years to Hon'ble Court that the official liquidator may be permitted to take possession of the same in modification of the order 3rd Sept. 1986 passed by Hon'ble Court in Company application No. 179 of 1986.
The Official Liquidator High Court Mumbai by removing or misplace with understanding 3rd Sept. 1986 order passed by Hon'ble Justice Pendse J from dated 3-9-1986 to 28-1-1998. The official liquidator High Court Mumbai, keeping same order with understanding 3rd Sept. 1986 passed by Hon'ble Justice Pendse J in M/s. Choonilal Manilal Pvt. Ltd. File not taken following item no. as per schedule as per said application dated 3rd Sept. 1986 which prove themselves smell of corruption involved against my Justice.

Ltd., company in liquidation has sold this item after winding up order has been passed on 3rd September, 1986, why Mr. Ujjwal Roy and M.A. Kuwadia has not taken any corrective legally action against Ex-Official Liquidator, High Court, Mumbai. Buyer of Bunglow and ex-Director Shantilal Choonilal Shah inspite of my and M/s. Ratilal Desai and Co. Advocate and Solicitor of Liquidator and complainant repeated request ? Today market value 20 lakhs. ( as on 1-12-2000)
Item No. 3 as per schedule : Registered Office at Yasuf Building, 4th Floor, 2800 Sq.ft., 49, Veer Nariman Road, Opp. Hutama Chowk, Fort, Mumbai - 400 023; Ex-Director Shri Shantilal Choonilal Shah of M/s. Choonilal Manilal Pvt. Ltd, has sold this item after winding up order has been passed on 3rd September, 1986, why Mr. Ujjwal Roy and Mr. M.A. Kuwadia has not taken any legally corrective action against the Ex-Official Liquidator, High Court, Mumbai, Buyer of office, landlord of Yasuf Building, who mis-guide Court with help of the Official Liquidator and Ex-Director Shantilal Shah inspite of my and M/s. Ratilal Desai and Co-Advocate and Solicitor of Liquidator, High Court, Mumbai and Complainant? To day market value Rs. 80 lakhs. ( as on 1-12-2000 )
Item No. 4 as per schedule : The Leasehold and bungalow known as 'Shanti Sadan with furniture, fixtures, fittings, therein at Choonilal Girdharlal Marg (Marve Road), Malad (West), Mumbai - 400 069, Ex-Director, Shri Shantilal Shah of M/s. Choonilal Manilal Pvt. Ltd. Company in liquidation has sold this joint hand with the official liquidator, High Court, the Liquidator Advocate and Solicitor M/s. Ratilal Desai and Co. buyer construction company of this assets is liquidator Advocate and Solicitor party. It is highly regretted liquidator Solicitor and Advocate Shri. Rameshbhai Desai fully aware of this matter and avoid his legally responsibility to inform facts in this matter to Hon'ble Court and when I approach our Chief Justice, Shri M.B. Shah, High Court, Mumbai, dated 29-10-1998 with detailed complainant. He resigns from this matter Shri. Shantilal Choonial Shah has sold and developed the properties by construction with 7th Floor on ownership flats and Shri. Shantilal Choonilal Shah purchase 7000 sq.ft. flat on same building in the name of trust. Trust deed he has made to transfer this company properties in his wife, Smt. Kokila Choonilal Shah and late Smt. Leelaben Harshad Shah, after winding up order passed in this matter on 3rd September 1986 by Pendse Justice and undertaking remove. Why Mr. M.A. Kuwadia, the Official Liquidator, High Court, Mumbai has not taken any legally corrective action against buyer of the flat owners. Buyers construction, Shri. Shantilal Choonilal Shah and the Official Liquidator and Advocates and Solicitors ? The value of this asset Rs. 500 Lakhs.C AS ON 1-12-2000 )
The North Canara bank, Shri Shantilal Choonilal paid company claim without informing the official liquidator after 10 years. Who was to blame in this matter responsibility?
Item No. 5 as per schedule : Residential Flat No. 70, 12th Floor, II wing and garage no. 3 on Ownership basis at 'Dariya Mahal', Nepeansea Road, Mumbai - 400 036, Ex-Director, Shri Shantilal Choonilal Shah of M/s. Choonilal Manilal Pvt. Ltd. (in liquidation) has sold this item were fully aware of pendency of winding up petitions at the time company flat was sold. Why ex-offica liquidator not taken any legally corrective action against Buyer and Ex-Director Shantilal Choonilal Shah, inspite my and M/s. Ratilal Desai and Company, Advocate and Solicitor of the Official Liquidator repeated request. The value of this flats Rs. 200 lakhs.( AS ON 1-12-2000 ) By an order dated 3rd September 1986, passed by His Lordship Mr. Justice Pendse, the official Liquidator was directed not to dispossessed the occupants of the Flat Owner referred to therein until further orders, in view of their undertakings recorded in the said Order and in terms of the said order the above Company Application was disposed of. The said order was passed in view of the Company winding up order passed by His Lordship the same day. Why the official liquidator High Court Mumbai till date not made application for removing undertaking to Hon'ble Court as per the order dtd. 3rd Sept. 1986.
Shri Shantilal Choonilal Shah sold above flat company assets and purchase other flat No. 52, Kshtiji Building, Hill Road, Bandra (West), Mumbai - 400 050 in the name of his wife, Smt. Kokilaben S. Shah and Smt. Linaben Harshad Shah, wife of ex-Director, Harshad C. Shah company in liquidation money. So last 14 years company has not hand over books of account and ledger to the official liquidator, High Court, Mumbai, which prove themselves that this is company in liquidation money. The Court, Mumbai, today value Bandra Flats Rs. 80 lakhs(AS ON 1 - 12--2000 ) the official liquidator, High Court, Mumbai, has not taken any legally action inspite of M/s. Ratilal Desai and Co-Advocate and Solicitor of the official Liquidator, High Court, Mumbai and my request.
Item No. 6 as per schedule : Company industrial gala No. 9 on ownership basis at Shamji Udhyog Nagar, Ramchandra Lane, Extension Kachpada, Malad (W), Mumbai - 400 064, Ex-Director Shri. Shantial Choonilal Shah of M/s. Choonilal Manilal Pvt. Ltd. Company (in liquidation) has sold this item were fully aware of the pendency of winding up petitions at the time company gala was sold. Why ex-official liquidator not taken any legally corrective action against buyer and ex-director Shantilal Choonilal Shah, value of this Rs. 10 lakhs( AS ON 1-12-2000 ). By an order dated 3rd September 1986, passed by His Lordship Mr. Justice Pendse, the official Liquidator was directed not to dispossessed the occupants of the Industrial Gala No.9 referred to therein until further orders, in view of their undertakings recorded in the said Order and in terms of the said order the above Company Application was disposed of. The said order was passed in view of the Company winding up order passed by His Lordship the same day. Why the official liquidator High Court Mumbai till date not made application for removing undertaking to Hon'ble Court.
I am confident that you will do your best and extend your valuable co-operation to end this injustice and delay for my right to sinking correct justice on dissolving the matter in justifiable manner from your end immediately as per my complaint dated 29-10-1998, Shri. M.B. Shah Hon'ble Chief Justice High Court Mumbai and my letter dated 21-05-2002 complaint to Shri. C.K. Thakkar, Hon'ble Chief Justice High Court Mumbai. take action who avoid his legally responsibility and normal duty in this case.
