    Subject: Complaint against Additional Chief Secretary of Maharashtra (IAS) Mrs. Vandana Krishna and Education Commissioner of Maharashtra (IAS) Mr. Vishal Solanki for issuing a notice to parents of Vibgyor in Maharashtra.

    Sir/Madam,

    We the undersigned, wish to bring to your notice that we the parents of VIBGYOR High School,
    Pune have been banned from meeting the Education Commissioner and other relevant officers from Education Department. Going to extreme lenghts, the Education Commissioner has issued a notice on the instructions of Chief Secretary Mrs. Vandana Krishna, stating that until Mrs. Prajakta Pethkar (our representative who has stood up for the rights of the parents & children of VIBGYOR and all the children of Maharashtra) apologizes to her she will not let us meet any of the officers. The saddest part is that they have defamed parents especially Prajakta Pethkar, Rupali Mahajan, Gunjan Mehta to an extent that

    we should never be able to speak for our rights and she could defame and create case against us or

    make them work their mandate. This behavior is not only demeaning and provocative but completely
    unlawful, going against our constitutional rights.
    1. We never sought any appointment to meet the Chief Secretary.
    2. It was an unexpected call to us to discuss our issues which was to our surprise.

    3. Despite of calling us herself, she gave only 2 mins and yet in those 2 mins she uttered all false
    and unlawful statements, not suiting her mandate and chair, enough for us parents to protest
    4. For detailed account of the incident, please refer the letter/proof attached to support our
    complaint.
    The IAS officer, especially the chief governing officer of the State are known to be a backbone of Indian
    Administration, responsible to maintain devotion towards their duties responsible to represent the nation for the respectable authorities here we are addressing our complain to.

    Where no government servant shall treat the public with grievances in a discourteous manner

    during the official hours or adopt dilatory tactics or willfully cause delays or deny their mandate. So can
    a government issue a show-cause notice to public at a wide end going against the welfare of the
    children’s education serve/rescue school management. It is seen that Mrs. Vandana Krishna’s ego is
    bigger than the suffering of parents. Govt. gives them the power to use it for the betterment of the
    society, but here it is clearly seen that she is misusing her power to save the erring school trustees of
    VIBGYOR by denying her mandate and asking parents to go to courts. And when we asked her in return
    she denied for that too. Finally had to get to sloganeering to which we have and particularly Mrs.
    Prajakta Pethkar, the representative of parents, has been asked to apologize to suppress her voice.
    Moreover, since the letter has been released, the officers of Education Department have started
    to harass us. For e.g. the current Deputy Director of Education Mrs. Meenakshi Raut who had been
    instructed earlier by the Education Commissioner to co-operate in the matter of FIRs against VIBGYOR High, has now started to avoid communication. This will have serious repercussions on our fight against

    the illegal deeds of the schools. We are fighting against a mighty lobby and know that we are risking our
    lives to make sure no one else suffers. Instead of helping, we are being harassed for raising our voice
    against the wrongdoings. We would like Govt. of India to remind all the officers that give courtesy and
    regards to the representatives of the people in larger interests of the country.
    There is no guarantee that even after tendering an apology (for doing nothing) she will work to
    her mandate, as she denied earlier giving false/wrong statements. We don’t even mind giving an
    apology because for us this cause is more important than the egos. Otherwise we will be no different
    than the egoistic and irresponsible chief secretary. Taking the welfare of the children’s education and
    parents’ rights, may we request you to immediately investigate her and the other officers like Education
    Commissioner (instructed by her). Conduct and also take the necessary action under the provisions of
    law, so that we parents get our constitutional rights back and also other officers on board learn a lesson
    and no other officer denies their mandate and stop the parents from meeting and address their
    grievances.
    We look up to your good self with high hopes that you will definitely give us justice and help
    bring the law mentioned in books to life and continue our faith further as we are left with no remedy.
    Now you tell us Sir, where do we go?

    Sir,
    We have been in touch and working along with your office since almost 5 months with regards to
    the illegal activities of VIBGYOR High School as well as the Education System in whole. You have always
    given us time, understood our issues, provided solutions or directions whenever needed and treated us
    with respect. We in turn have also given you respect, spoken to you politely, kept our patience and have
    spread a good word about your work ethics.
    On 30th August 2018, we got a call by Mr. Pawra (PA to Education Commissioner) who said ‘The
    Education Commissioner has invited you to come and meet Mrs. Vandana Krishan at Balbharti @ 4:00 PM
    on 31st August 2018’. After Nandkumar was moved from the post of Principal Secretary (Sports &
    Education), we were elated to know that finally there is one responsible officer on the very important post
    who is coming all the way from Mumbai to listen to our issues and give justice to us. We even bought a
    bouquet to welcome her to Pune. Dressed up in formals for such an important meeting, we reached at
    sharp 4:00 PM.
    We saw there were several other parents waiting. You came in after some time and told us that it
    will take some time. Though we had left our kids alone at home, we said we will stay as long it is needed,
    be it 12:00 at night. If Mrs. Krishna can come all the way from Mumbai for us, we can definitely wait for
    her. That’s how much respect and hope we came with that day.
    Around 6:30 PM we were called inside the conference room where Mrs. Krishna, you and several
    officers were sitting upfront. Some more Education Department officials like Mr. Dinkar Temkar, Mrs.
    Meenakshi Raut, Mr. Shintre, Mr. Godhane and others were sitting across. We entered the conference
    room only after asking Mrs. Krishna’s permission to enter. We gave her the bouquet and wished her a
    “Good Evening”, but she didn’t accept the bouquet, just moved it aside reluctantly. We ignored that and
    asked for her permission to sit as we were standing right in front of her surrounded by all the officers. She
    said, “No, you can’t, I don’t have time, you stand here in front of me and speak in 2 mins”. We said, “We
    have been suffering since past 5 years, how you expect me to tell in 2 mins?” On that she said, “I will give
    time later, you tell me in only 2 mins.” We tried to convince her and requested that, “We will brief you in
    10 mins”. But she said “no, only 2 mins” without even looking us in the eye. We felt insulted by her
    behavior with all the officers sitting and only all of us parents standing. We once again ignored it and
    started putting our prayers in front of her. We asked her to cancel the NOC of VIBGYOR and all the schools
    (as it is her mandate) that have been found guilty under the law and finished talking as there was no time
    given. She hardly heard us and without knowing our story started giving contradictory statements. Did you Page 2 of 11
    find her statements appropriate? Did you find her answers to our questions correct? Could you not see
    how she treated us mother parents like criminals? If not, here’s a flashback to help you remember all that
    happened that day:
    1. We: “schools are selling uniform/books in the campus, flouting the norms of GR # 1” Mrs.
    Krishna: Does this rule apply to private schools?
    We: “Yes Madam, this law is applicable to all schools”
    2. Mrs. Krishna (with a … smile and not looking towards us): “Why do parents put their children
    in private schools? why dont you put them in Govt. schools?” The lady officer next to Mrs.
    Krishna along with some more officers started laughing at us.
    We were taken aback by her statements
    We: “this forum’s time is not for discussion on where we put our children, but to take action
    on the erring schools on violations as per your mandate. this is purely our decision. but it
    doesnt mean schools flout the rules and the department sets them free. Still we will be the
    first ones to put our children in Govt. school provided you open all the 1300 govt. schools
    shutdown by the Education Minister Vinod Tawade & improve the quality of these schools.
    We are ready but are the schools ready? Already there is a huge budget of 800 crores and
    additional 200 (approx.) crores sanctioned by our Prime Minister Mr. Narendra Modi &
    Finance Minister Mr. Arun Jaitley. Where did all the money go? Why is it not being used to
    improve the quality of the Govt. schools instead the minister is closing the existing open ones?
    3. We: “As VIBGYOR has no permission/recognition/NOC renewal neither have they submitted
    the certified copies of the audit report as per mandate to the PMC/ZP, why don’t you shut
    down private schools like these instead of closing the Govt. Schools?
    Mrs. Krishna: “this does not fall under our jurisdiction and I cannot do anything about it. You
    go to the courts.”
    We: “why should we go to the court when it is your (the State of Maharashtra) mandate.
    Prime Minister Mr. Modi has already mentioned that the courts’ burden to be reduced by
    addressing grievances/issues at the Govt. Offices level in a limited time once the complaint is
    lodged. Then why are you asking us to go to courts? On the other hand, courts have disposed
    off 8 out of 10 parents’ petitions in a row in 2 years down the line stating ‘parents have no
    locus/rights to file a complaint or stand against schools redirecting them back to the Education
    Department. If we parents have no locus in front of your chair nor in courts, then where do we
    go?”
    4. Mrs. Krishna: “I don’t know about all that, just give me your points on
    suggestions/amendments in policies if you have any.”
    We: “We have already submitted our suggestions last year in May-June for amendments in
    Fee Regulation Act 2011, but Education Minister Vinod Tawade conveniently neglected all of
    those and got only those points that were beneficial to school managements passed in the
    Vidhan Sabha.”
    5. Do you think speaking in 2 mins, not allowing us to explain our grievances with evidences in
    detail & on top of that saying ‘we can’t do anything’ is going to solve our problem? if none of
    what we say falls in your jurisdiction why did you call us here today? If you cannot do anything
    and want us to go to courts then give it us in writing. We will send you an email with detailed
    list of what are the mandates of your chair. To accept or reject those is up to you. Thank you. Page 3 of 11
    We left the conference room feeling dejected. We saw that Mrs. Krishna is not going to do
    anything to alleviate the pains of parents and your attempt to help us meet her has failed. We felt bad
    that not once did you try to step in to explain her our situation. If we were wrong you could have stopped
    us right then n there. None of the officers including you tried to explain her how the school is
    contravening the laws and how we parents are facing hurdles. You kept telling us that we will meet later
    and discuss. We were supposed to meet Mrs. Krishna, we were to update her about all the misdeeds going
    on in her Department, then how meeting you later would have helped?
    We were standing outside when another parent named Marzi was called inside the conference
    room and within a minute we heard some loud voices, so we ran inside to see what’s wrong. We saw
    Marzi being held by 4-5 officers. We are aware of his case and how your department has handled it
    insensitively. He has been running around since almost a year now to get justice for his son. On top of that
    the then Deputy Director of Education Dinkar Temkar had called his son ‘abnormal’ on several occasions,
    which any parent would not tolerate. That’s very insensitive of Mr. Temkar. When we saw him being
    mistreated, we too joined him saying ‘we will complain regarding this along with you’. Mrs. Krishna along
    with all the officers left the conference room right then, and we knew that she won’t do anything for the
    parents, infact we might face more hurdles now, which angered every one of us and that’s when we
    shouted slogans of ‘Vandana Krishna hai hai, leave the chair’ (‘वंदना कृçणा हाय हाय, खुचȸ सोडा’).
    All the officers left and we stood there with our questions/matters as is. Ex Principal Secretary
    Nandkumar did the same thing a couple of years ago. We have lodged an NC against him and the case is
    pending in the District Court, Pune. If this is how parents are treated by the Ministers, Education
    Department officials on top posts, then how do you expect respect from us? We parents are treated as
    dirt and the School management that is continuously flouting norms, breaking laws are being saved by you
    people, then give us a good reason as to why shouldn’t we ask you to get down from your positions. If she
    doesn’t know her mandates she better study first and then speak as giving such irresponsible statements
    doesn’t augur well to the reputation of her position. You are playing with the sentiments of parents and
    that is totally unacceptable. Your bosses can’t take action on the erring school trustees but can take
    actions on parents especially Mrs. Pethkar who is the representative of a large mob and is standing for
    children’s welfare for their education.
    What did you want to prove by giving us 2 mins to speak? That you are helping us? Or you
    purposefully did all this to defame us? If you recall, we have never resorted to such behavior of this kind in
    your office. You witnessed whatever happened on the 31st, yet you blame us. You cooperated with us
    because that’s what public servants are supposed to do. Please don’t mislead the general public by
    showing off as if you have done us some favor. And to bring to your attention, only exchanging
    letters/emails doesn’t mean cooperation. Taking action (for real) on the erring schools that are flouting
    the rules/contravening the laws is mandatory for you/your office. And also taking action on the officials
    who are not following your instructions. Whenever it has come to taking real action against the
    schools/Education Department officials, you have diverted from that by one way or the other, including
    defaming us like we are being right now.
    Its natural tendency Mr. Solanki, you get respect if you give respect. The way you respected us we
    respected you back and we think that was the reason you always allowed especially three of us viz. Mrs.
    Pethkar, Mrs. Mehta and Mrs. Mahajan to speak and ask the rest of the parents to wait outside. We hope
    you remember that. Page 4 of 11
    Other than this we want to inform you that Mrs. Raut has taken disadvantage of you taking out
    such a notice and now has again indulged with the school management and not helping for Courts and
    Commissioner of Police to start the investigation fresh and get the C-summary cancelled. She is not ready
    to get the APP changed as he has been challenging our locus and Mrs. Raut has no control over what he
    says or submits in the court. Neither is she sending the letter to the Commissioner of Police to change the
    IO and start the investigation afresh. Your notice had no strict instructions to her mandate, yet she, along
    with some other people who are not directly associated with the Deputy Director’s office, have conspired
    and are obstructing the flow of justice putting our children at a huge risk. If you don’t stop her soon and
    work in support as we had decided in our meet, we parents of VIBGYOR will ensure she is exposed for
    signing such a document and involving in the conspiracy, which is a fact we all including you decided to
    ignore to set the FIR right. If you fail to instruct her, it will prove that you have no control over the
    conspiring officers and are here to just take instruction of your boss even if it goes against the parents’
    justice and rights, but don’t have the power to stop the schools doing violations and contravening the law.
    If anything goes wrong with these cases, you and Mrs. Krishna will be solely responsible for everything.
    Now let’s move on to the letter you gave on 17th September 2018:
    1. You have mentioned in the letter that ‘we have misbehaved with other officials and have done
    this several times before and broken the rules of a public office’. If you really want to know, these
    were the officers who had misbehaved with us, not keeping in mind their position/responsibilities,
    lied to the public, misled us, refused to meet us despite following every single protocol, behaved
    indecently with lady parents, threatened us with Police action just to scare us and shoo us away,
    and on other hand they were favoring the school management, advocating the school’s misdeeds
    as legal which is a grave danger to our rights as parents and to our children’s right to education. If
    trying to meet officials (after following all protocols) and raising our voice for our rights is
    ‘misbehaving’ then we will do it over and over again for the future of Maharashtra’s children. We
    cannot just let it go while corrupt officials who are hand in glove with the school managements
    take us for a ride. When we bring to notice any such behavior of the officers, the officers are
    promoted instead of being punished for their behavior. For e.g. Mr. Dinkar Temkar (the then
    Deputy Director of Education) took cognizance of one parent’s complaint on his personal
    whatsapp and resolved his issue in just a few days, while we still are facing the issue despite
    following the protocol and giving written complaints. Why is such behavior of the officials not
    punished, why are they promoted instead? Are they held accountable for all the work NOT DONE?
    And if you do not believe us, please go through the CCTV footage of all the incidences and let’s
    have a meeting with the media as witnesses to each of those and let the media decide who is at
    fault. Also, please get the CCTV Footage of 31st August 2018 between 4 PM and 8 PM and then
    blame us if you find us guilty. If you think the way we behaved with the officials is an insult to
    them, then why doesn’t their behavior with us seem demeaning/degrading to you? The corrupt
    practices and behavior of your department’s officers is crushing our constitutional rights as the
    citizens of this country and our children’s future. How do you expect us to just keep mum and take
    all the injustice with our heads hanging low as if we are the culprits? Isn’t your letter an example
    of victim shaming?
    2. One of the most important protests we have held so far was on 7th March 2018 as we HAD to
    meet the Chief Minister of Maharashtra Mr. Devendra Fadnavis because the Education Minister
    was not doing anything concrete and was just giving statements in press. We wrote to the CM’s Page 5 of 11
    office well in advance with our prayers. But we didn’t receive any acknowledgment. Almost every
    other day you see that the CM is attending functions of Bollywood celebrities and inaugurations of
    jewelry shops, but has no time for the suffering parents of Maharashtra. We reached Mumbai
    early on the 7th of March but were made to wait at the Marine Drive Police Station for hours
    together. We somehow managed to reach the Vidhan Bhawan where police used force on us,
    dragged us by our hair and threw us in the van. Mrs. Gunjan Mehta was hurt so badly that she
    had to be admitted to the hospital. We were harassed at the police station by various means
    including threatening us that FIR will be lodged against us. But at the end of the day, around 7:30
    PM we got the news that one of our most important and ethically, legally correct demand was
    fulfilled by releasing a ‘GR (# 201803071606023821) which authorized the Deputy Director of
    Education of each district to take action against the schools that are contravening the law’. We
    were glad to see the GR but we paid a price for it by staying away from our children for days,
    getting beaten up badly for something that could have been solved easily by discussion. We are
    not fond of getting out on the street or shouting slogans, its the education department’s inactions
    are forcing us to call up andolans.
    3. We have given numerous complaints to the Education Department, followed every protocol but
    where is the action on the school? Yes, there were orders given to the school, but the school
    never followed any of it. It is indeed the mandate of Mrs. Krishna’s position to cancel the NOC of
    the school. Then why is she running away from it?
    4. Let us remind you that you are a public servant and not a monarch where you are treating us like
    slaves misusing your powers. You are besieged with a colonial mindset hence we insist on you to
    come out with the CCTV footage and prove it in the media. The ego of your bosses so big than the
    cause and the pains we had been going through since 5 years who will apologize to us for that?
    Instead you are denying your responsibilities that are your mandate. Only when you get rid of the
    ego and stop treating yourself big and others small, you will be able to solve problems by
    discussing them.
    5. We are the regular taxpayers and respectable citizens of this country with our own stature and
    dignity therefore you do not have the right to treat us like garbage and you all owe us an
    explanation and apology for the inaction and mistreatment of all parents of Maharashtra, as this is
    not just one incident, there have been several against parents. We mother parents are in fact
    helping your department by throwing light on the illegalities of the school managements such as
    VIBGYOR High (which should solely be taken care of by your department). These private schools
    get permission and NOC from your department and once they start running they throw every
    single order you send their way into the trash bin. You show no intention to punish them for
    their wrongdoings and when we expose that you defame us so we shut ourselves up?
    6. The FIRs on VIBGYOR High, Magarpatta (31st March 2018 FIR # 348/2018) and VIBGYOR High,
    NIBM (5th April 2018, FIR # 222/2018) have been lodged based on the inspection reports of your
    department and after careful scrutiny by the Deputy Director of Education. Fee Regulation Act
    2011, Prohibition of Capitation Fee Act 1987, Advisory for Corporal Punishment 35(1) and Right to
    Education 2009 are the basis of those FIRs and Mrs. Krishna is denying the applicability of these
    laws to the Private schools also GR#1 Prohibition of sale of books and stationary is not applicable
    to minority schools is what she said. If she did not know our matter then how did she know that
    VIBGYOR is claiming to be a minority institution? On one hand Deputy Director of Education
    Jadhav and you concurred that the laws are indeed applicable to private schools and on the other Page 6 of 11
    hand Mrs. Krishna says ‘No’. This puts us parents in a very difficult situation and we suffer. We
    have to keep a close eye on the school’s misdeeds ourselves as your department is always keen
    on shrugging off their responsibilities. Despite of knowing all this, the school trustes/owners are
    walking around freely while vigilant parents like us face defamation and bans from your
    department. What an irony!
    7. The Education Minister of Maharashtra is felicitating the same VIBGYOR Trustee Rustom Kerawala
    on whom there are 3 FIRs lodged. Rustom Kerawala is roaming free, thanks to Ramchandra Jadhav
    who has given contradictory statements on the same FIRs that were lodged by him on the basis of
    inspection reports, verified very well before lodging the FIRs. He, along with the IO Sudam
    Pachorkar hurriedly wrapped up the investigation midway and filed a C-Summary, trying to make
    the case weaker. The existing law is not being implemented and we are asked to suggest
    amendments and at the end the minister only gets those points added that favor the school
    managements. The Palshikar committee for FRA amendments was just a farce.
    8. When Mrs. Krishna said ‘I can’t do anything. Go to Court’, how come your letter says ‘give us your
    matter in writing and we will work on it’. We need clarity as to whether you will work on our
    matters or not, so please ask Mrs. Krishna if you are allowed to work on our matters. It is her ego
    that she doesn’t even see the sufferings of the parents and children of Maharashtra. As per your
    letter, if particularly Mrs. Prajakta Pethkar apologizes to her, she will allow us to meet you and the
    other officers of your department. Mrs. Pethkar is the mother parent who has been running from
    pillar to post while disregarding her own health in delicate times like pregnancy/delivery to an
    extent that she was about to slip in to coma, taking this corrupt system head-on since almost 5
    years now despite all that, fighting against a big lobby lead by Rustom Kerawala who influences
    everyone with the power of money. Her determination and fearless attitude inspired us other
    parents to join hands with her and face this with grit and a collective determination. We are
    fearless because we know we are right. Had we been wrong we would have been fearful, but
    we are not a tiny bit afraid.
    9. Why is Mrs. Prajakta Pethkar being targeted when there were other parents also during the
    meeting? Is this a conspiracy to defame her particularly, just like VIBGYOR Trustee Rustom
    Kerawala through his lawyers, does on every platform?
    10. Never during the whole meeting did Mrs. Krishna look us in the eye and only a person who is not
    true to himself/herself does that. We were looking her in the eye but she was not. She made us
    stand while all you officers were seated. Who does that? Were we criminals to be treated so
    badly? We are mother parents fighting for our rights. An officer treating any parent in such
    demeaning manner is unacceptable. Our sufferings, our problems, our concerns didn’t make it
    to her ears, only thing that did was the slogans we gave, which hurt her ego and this letter
    proves it.
    11. You are asking us to give our matter in writing, but what has happened in the matters we wrote to
    you earlier? None of the following matters have seen a logical end.
    a. We have brought it to the notice of VIBGYOR several times that, we are not only protected by
    the existing law which declares demand and collection of illegal excessive capitation fees as
    cognizable offence but also by the Hon. SC constitutional bench judgement in TMA Pai and PA
    Inamdar. Yet, the school management comments in the media that we have not paid the fees,
    which is not true. We have not paid the hiked fees only which means the rest of the fees
    amounts to more than 90% of the total fees has been paid. Yet they are not providing books Page 7 of 11
    to our children, nor are they making them available in the market. Moreover, they recently
    started selling books individually but particularly have blocked the sale of books to us. This is
    keeping away our children from the right of education. Our children are treated badly for not
    having books, humiliated in front of the rest of the class, discriminated against. What have you
    done in this matter? Have you made sure our children receive their books?
    b. Have you put VIBGYOR High in black list for sale of books and stationary on campus? Have
    you cancelled their NOC for not following GR#1?
    c. On one hand VIBGYOR is demanding Rs. 90,000+ for giving LC/TC to parents and on the other
    hand influential parents got the LC/TC home delivered without paying a single penny. The
    common people who are working without any political or influence who are following all
    protocols and complaining in writing at your office are still waiting for justice. Did you lodge an
    FIR against the school for profiteering?
    d. VIBGYOR High is working without the necessary recognition/permission, when will you take
    some solid action against them such as an FIR?
    e. You had formed the Supe Committee in the month of May 2018, under the supervision of the
    Director of Education Mr. Sunil Chauhan, do deal with the above points. No report whatsoever
    or status of any kind has been shared with us. Has the committee worked? If yes, then where is
    the report?
    f. For conspiring against the FIRs lodged against VIBGYOR High, you were going to set up an inquiry
    and take action against Ramchandra Jadhav and Dhanaji Butte. What is the status and report
    of the committee?
    g. How come Temkar and Butte were promoted despite your promise of taking action on them?
    h. The APP (Assistant Public Prosecutor) appointed by the Govt. for the FIRs on VIBGYOR High,
    started challenging our locus instead of talking from our side and we had requested that he be
    changed and that too before 27th September 2018 i.e. the next date for hearing. That is the
    reason we wanted to meet you but you instead of meeting us, came up with this ban on us.
    i. You had assured us a meeting on the 19th July 2018 to discuss about the suggestions for
    amendments in Fee Regulation Act 2011, but when we checked with you last time, you said
    your seniors have asked to call off the meeting. Meanwhile, the Education Minister has very
    smartly gotten the draft with anti-parent amendments passed at the Vidhan Parishad secretly.
    We have not received the copy yet from your office either. If a parent complains against a
    school, there is so much that he/she has go to through, so very few like us come forward.
    Hence, the inclusion of the point where 76% of parents will have to come forward to complain
    and only then the complaint will be considered by the committee, which we think is snatching
    away our constitutional right. None of the points that we suggested has been included in the
    draft. Total transparency will be maintained is what we were promised but that doesn’t seem
    to be the case. Utmost care is being taken so that parents do not get a say in this matter.
    These are just some points that you had promised action upon, but we have yet to see any action. Then why
    are you asking for more matters in writing?
    Numerous orders have been sent from the Education Department to the VIBGYOR School which
    mentioned that if the school does not follow the orders, the school will be dealt with appropriate Page 8 of 11
    punishment as per your mandate. But the point to note here is not a single action has been taken by the
    department on VIBGYOR, though they have been throwing the orders in the trash bins. We think you should
    also mention on the orders ‘as to how many years do the parents have to wait, until the action takes place
    so that parents are not under the wrong impression that once an order is served to the school the job is
    done’. You are incapable of following through your own orders and from your inaction on VIBGYOR we are
    clever enough to know what ties up the hands and makes your department mum.
    And when we come to confront you on these inactions, you call the police force to threaten us with
    dire consequences. Who do you think we are? We are just common people, parents who are seeking justice
    for our children’s academic future. The ones who are breaking the law, contravening every provision of law
    is roaming around freely as you are not taking action on them and then you threaten us instead.
    Not to forget the attitude of Police in such matters. The Investigating officer PI Sudam Pachorkar
    omitted all the important points such as Audit reports, profit and loss statements, accounts of school etc.
    He did not take our statements though the main complainants’ witness is of utmost importance. We had
    even sent reminders to him by letters and phone calls so that he does not forgo the statements. But we
    noticed that he and the other officers of Kondhwa Police Station started avoiding us. Meanwhile, (the very
    famous fraudsters) Ramchandra Jadhav and Dhanaji Butte had given word to word copy of each other’s
    additional statements which gave the utmost rubbish and silly reason to quash the FIRs that they did the
    FIRs as a misunderstanding, though the FIRs were done based on reports that proved the school guilty. Also,
    Butte and clerk Talekar together conspired and made Mrs. Meenakshi Raut sign wrong document on a
    pretext of hurry based on which the IO filed the C-Summary in the court. The C-summary was filed such that
    not even the Deputy Director who filed the FIRs was aware of it, so that the news doesn’t reach us by any
    chance and it is easy to safeguard the school trustee from getting arrested. When we found out about this
    we approached the Comissioner of Police Dr. Venkatesham and requested him to change the IO and set up
    an enquiry on PI Sudam Pachorkar so that no other officer dares to mess with these cases. Also, requested
    him that the investigation be carried out by a new, honest and capable police officer or hand it over to CBI.
    (These FIRs on VIBGYOR are high profile cases and there is a high probability of tampering by the wrong kind
    of people. In fact, the tampering is on going).
    We have given the following points for the re-investigation, which should have been given by the
    Deputy Director of Education (as it is his/her mandate) and should have been studied by the IO and
    understood clearly. Yet, here we, the complainant parents are doing their job. This is nothing but deliberate
    attempt of ignoring their duties. Let us see now how the Commissioner of Police and the Deputy Director of
    Education take this up.

    If all these points are investigated thoroughly, it will be clear whether the school is guilty or not.
    12. You are saying unconditional apology.
    a. First of all, apologize for what? Paying taxes regularly, because of which all the govt.
    officials get their salary, is that our mistake? Being alert of the wrong doings happening
    around us and raising voice against it, is that our mistake? Raising our voice against the
    institutes that treat your orders as garbage and contravene every law, is that our mistake?
    We seek convincing explanation on all comments made, otherwise we shall produce all
    the proof on record how your department has behaved biased, including the FIR where
    your officials made adverse representation for few thousand bucks
    b. Instead, you owe us an apology for harassing us, insulting us and speaking lie to us about
    your mandate.
    c. Mrs. Prajakta Pethkar is a parent representative and has been working for the rights of
    parents of VIBGYOR High particularly as well as parents of Maharashtra. Being an IAS Mrs.
    Krishna is not supposed to treat a parent representative in a demeaning manner as ‘an IAS
    officer especially chief governing officer of the State are known to be the backbone of
    Indian administration, responsible to maintain devotion towards their duties, no
    government servant shall treat the public with grievances in a discourteous manner
    during official hours or adopt dilatory tactics or willfully cause delays or deny their
    mandate.’
    d. You have to immediately withdraw the letter issued to Mrs. Pethkar and you have to
    tender a public apology to the Prajakta Pethkar Education Trust’s committee viz. Mrs.
    Gunjan Mehta (Vice President), Mrs. Rupali Mahajan (President) and especially Mrs.
    Prajakta Pethkar (Chairwoman) for ordering this ban on her which doesn’t fit any legal
    angle and has defamed her and the VIBGYOR parents in general.
    e. This letter is only to shunt us into forcible submission to your egoistic dictate, including to
    hide the collusion of your office in subverting the laws, assisting and facilitating the
    private school owners go berserk, looting parents, torturing students, doing all sort of
    illegal acts.We still will not mind feeding your egos or your bosses egos, for whom working
    or giving ears to parents is not important but maintaining their respect is
    f. Though we are not wrong, we will definitely apologize provided you take action on
    VIBGYOR, immediately cancel their NOC. (Yes Sir, conditions apply) which she has already
    denied which made us shout slogans at her.
    g. If you fail to give satisfactory reasoning asking us to apologize, it amply proves our
    allegation stands right. You should tender an unconditional apology to parents fraternity
    in the State of Maharashtra for failing to protect the fundamental rights of students to
    free education enshrined in Constitution of India. If you feel this is too much, please file
    FIR against us on issues mentioned in your letter and our reply, at least this will take this
    cause forward.
    h. Collection of illegal, excessive and capitation fees is declared cognizable offence and that
    all you have to take action against it being a public servant duty bound to take appropriate
    action against service rules applicable to you and also Indian penal code too, it is clear that
    you all have committed criminal conspiracy and our minor children are being harassed
    because of your criminal conspiracies and negligence in duty. Further you have made
    defamatory remarks against us, hence we give you last opportunity to withdraw this letter Page 11 of 11
    and tender an unconditional apology further take immediate punitive and criminal action
    against VIBGYOR school which is running without norms and following mandatory
    permissions which have caused loss to public exchequer too under RTE, FRA and
    Capitation Fee Act 2011, failure to do so shall result into filing appropriate criminal and
    civil proceedings against you.
    We have no other option but to call for an andolan against this dictatorship and the misuse of
    power by the education department against the parent fraternity. We are also contemplating lodging an
    FIR under IPC Sec 499 against Mrs. Krishna and all officers who refused to meet us as per her instructions.
    We have strong doubts if she has received gratification from VIBGYOR school management which is
    running without proper mandatory recognition under RTE and flouting norms too and hence complaint
    shall also be made against her under relevant provisions of law.
