આ કેસની ટૂંકમાં હકીકત એવી છેકે, િવવાદીએ હેર માિહતી અિધકારી ી પાસેતા.૧૭/૧૦/૨૦૧૬ની નમુના‘ક’ની અર થી
કેટલીક માિહતી માંગી હતી. િવવાદીએ થમ અપીલ સ ાિધકારી ીનેતેમની તા.૦૫/૧૨/૨૦૧૬ની અર થી થમ અપીલ કરી
હતી. િવવાદીએ આયોગનેપણ અપીલ કરતાં આયોગેતેમના તા.૦૮/૦૬/૨૦૧૭ના હુકમથી થમ અપીલ સ ાિધકારી ીનેયો ય
િનણ ય લેવા માટેઆદેશ આપેલ હતો.
૨. આ અપીલની સુનાવણી આયોગમાં તા.૨૬/૦૪/૨૦૧૮ના રોજ હાથ ધરવામાંઆવી હતી. સુનાવણીમાં િવવાદી હાજર રહેલ
છે. િતિવવાદી પ ે હેર માિહતી અિધકારી ી અનેઅપીલ સ ાિધકારી ી કેતેમના કોઇ િતિનિધ હાજર રહેલ નથી કેતેમના
તરફથી કોઇ લેિખત રજૂઆત પણ મળેલ નથી.
૩. િવવાદીને બ માં પૂછતાં તેઓ જણાવે છે કે, તેમણે તેમની
તા.૧૭/૧૦/૨૦૧૬ની નમુના‘ક’ની અર થી હેર માિહતી અિધકારી ી પાસે માિહતી માંગેલ હતી. હેર માિહતી
અિધકારી ીએ તેમના તા.૨૧/૦૩/૨૦૧૭ના પ થી િવવાદીને૧ થી ૬૪ પાનાની માિહતી આપેલ છે. િવવાદી જણાવેછેકે, તેમને
તેપ અનેતેની સાથેની ૧ થી ૬૪ પાનાની માિહતી મળેલ છેઅનેતેમાિહતી િવવાદી બ સુનાવણી વખતેબતાવેછે. િવવાદીની
રજૂઆત છેકે, તેમણેમાંગેલ માિહતી તેમનેઅધૂરી મળેલ છે. તેઓએ કેટલા મુ ાની માિહતી માંગેલ છેતેઅંગેિવવાદીનેપૂછતાં
તેઓ જણાવેછેકે, તેઓએ કેટલા મુ ાની માિહતી માંગેલ છેતેતેમનેખબર નથી, પરંતુ હેર માિહતી અિધકારી ીએ તેમનેજે
માિહતી આપેલ છેતેઅધૂરી છે, તેતેમનેબરાબર ખબર છે. િવવાદીની રજૂઆત છેકે, હેર માિહતી અિધકારી ી સામેિશ ા મક
કાય વાહી કરવી જોઇએ.
૪. કેસના કાગળો, બ અનેલેિખત રજૂઆત યાનેલેતાં, હેર માિહતી અિધકારી ીનેહુકમ કરવામાં આવેછેકે, િવવાદીએ
તેમની તા.૧૭/૧૦/૨૦૧૬ની નમુના‘ક’ની અર થી માંગેલ માિહતીમાંથી, રેકડ ઉપર ઉપલ ધ હોય તેવી માિહતી, માિહતી
અિધકાર અિધિનયમની જોગવાઇને યાનમાં રાખીને, દવસ૩૦માં િવનામૂ યેિવવાદીનેઆપવી. આ હુકમ સાથેઆ અપીલનો
આયોગ વારા િનકાલ કરવામાંઆવેછે.
